Members of the armed services are subject to military law as
well as to the ordinary law of the land, and may be tried by
court-martial for any offence committed abroad, and for all
except the most serious offences, for example treason and murder,
committed in the UK.
There are two types of court-martial:
-district courts-martial, consisting of at least three officers,
which deal with lesser offences committed by ‘other ranks’,
and
-general courts-martial, consisting of at least five officers,
which deal with the more serious offences committed by ‘other
ranks’ and with all offences committed by officers.
From the decision of a court-martial appeal lies to the Courts-Martial
Appeal Court, which is the Court of Appeal – Criminal
Division by another name with the addition of some Scottish
judges, and thence to the House of Lords in appropriate cases.
