The Family Division deals with the following matters:
-non-contentious or common form probate business, that is,
the granting of probate where there is no dispute as to the
grant:
-proceedings relating to the presumption of death;
-proceedings relating to the dissolution of marriages
(divorce);
-matters relating to legitimacy, validity of a marriage, nationality,
and matrimonial status;
-proceedings in connection with the wardship of minors, adoption,
guardianship of minors, and other matters in connection with
the care, custody, and control of minors, including proceedings
to obtain the court’s consent to the marriage of a minor;
-disputes between spouses as to their respective rights to
property, including disputes as to entry to and occupation
of the matrimonial home;
-the enforcement of maintenance orders.
The Divisional Court of the Family Division is concerned with
appeals from the County
Court and from magistrates’
courts on a number of matters connected with matrimonial
disputes and the affairs
of minors.
