The Judicial Committee of the Privy Council is the final court
of appeal from some Commonwealth countries and colonies, from
ecclesiastical
and prize courts, and from the Channel Islands and the Isle
of Man.
Strictly it is not within the system of English courts, but
the majority of the members who hear appeals are the Lords
of Appeal who perform the appellate functions of the House
of Lords.
It is for this reason that judgments of the Privy Council
receive so much respect in English courts and are regarded as
persuasive precedents which will be followed unless there is
some cogent reason for departing from them. The importance of
the Privy Council has been eroded in recent years as some countries
have left the Commonwealth and others, while remaining in the
Commonwealth, have decided to establish their own supreme courts
from which there is no appeal. The Privy Council is not bound
by its own previous decisions.
