A person under eighteen years of age may be referred to in law
as either an infant or a minor; current fashion favours the
latter term. The rules relating to minors’ liabilities
in respect of crime, contract and tort are dealt with in chapter
5, 6 and 8 respectively. Other important rules relating to minors
are that:
-a minor cannot vote or sit in Parliament or on the council
of a local authority;
-he cannot sit on a jury;
-he cannot make a will unless he is a member of the armed services
on active military service or a seaman at sea;
-he cannot take part directly in litigation; he may, however,
bring an action through his next friend, or defend an action
through his guardian ad litem. Normally, it is his father or
legal guardian who acts in these capacities.
