Rehabilitation of offenders
The Rehabilitation of Offenders Act 1974 aims to restore the
reputation of convicted persons who have not committed another
crime for a specified period after their convictions. A convicted
person who has received a sentence of not more than 30 months’
imprisonment and who has not committed another offence during
the rehabilitation period is under no obligation to reveal the
offence for any purpose, for example, when seeking employment
or when applying for insurance: the conviction is said to be
spent. The benefit is lost if he commits another serious offence.
The rehabilitation period varies depending on the length of
sentence which has been served, and is a maximum of ten years.
It should be noted, however, that a sentence of more than 30
months is never spent, so that a person who has committed a
very serious crime is never freed from the necessity to disclose
it under appropriate circumstances.
