The Courts

 


Nearly all minor civil cases are heard in the County Court, a purely civil court, and the more serious cases are heard in the High Court, which is mainly a civil court. Appeals from the County Court and the High Court lie to the Court of Appeal – Civil Division, and thence to the House of Lords, the only court which has equal jurisdiction in both civil and criminal matters (although the procedure when hearing a civil case is different from that when hearing a criminal case).

Magistrates’ courts deal with the great majority of minor criminal matters, and have very little civil jurisdiction.
Major criminal cases are heard in the Crown Court, a purely criminal court, with appeal to the Court of Appeal – Criminal Division, and thence to the House of Lords.
It must be noted, however, that although the systems of courts are more or less distinct, very often the same judges sit in both civil and criminal courts.
A High Court judge, for example, may find himself hearing an appeal from a VAT Tribunal decision one week, and a murder case the next.
